Marketing&PhotoVideo LTD — Privacy Policy & Refund Policy

Last updated: 1 Sept 2025

Privacy Policy

This Privacy Policy explains how Marketing&PhotoVideo LTD ("we", "us", "our") collects, uses and protects your personal data when you use our website, digitalmarketingdemand.com, and the services we provide through it (together, the "Services").

Marketing&PhotoVideo LTD is a company registered in England and Wales, with its registered address at 42 Stoneleigh Crescent, Bristol, BS4 2RQ, United Kingdom. For the purposes of UK data protection law, we are the "data controller" of the personal data described in this policy.

We need certain information in order to provide the Services to you. If you choose not to provide it, or ask us to delete it, you may no longer be able to access or use all or part of the Services.

The information we collect

1. Information you give us directly

We collect information directly from you when you:

  • register for an account or when we administer your account;

  • send us questions, enquiries, communications or feedback by email, online form, WhatsApp or social media;

  • take part in our research or surveys; and

  • request customer support or technical assistance, including through online chat, messages and text messages.

The types of information we collect directly from you include:

  • name, postal address, telephone number and email address;

  • billing information, such as card details, bank account details and identity verification information, which is collected by our payment processors on our behalf (we do not store full card numbers ourselves);

  • log-in credentials;

  • information about purchases or other transactions with us;

  • information about your customer service interactions with us;

  • content you post in public areas of our Services; and

  • any other information you choose to give us in connection with your use of the Services.

2. Information we collect automatically

We and our service providers (third-party companies that work on our behalf) use a number of technologies to collect information about how you use the Services and the devices you use to access them.

Visitor data. When you use our website we collect information that helps us understand how you interact with our Services — for example domain names, browser type, operating system, browser plug-ins, cookie preferences, search engine keywords, the pages you viewed and how long you spent on them, and the terms you searched for on our website.

Location information. We and our service providers may collect general location information (such as your IP address and the city or postcode associated with it) from your computer or mobile device. This allows us to show content that varies by location and to apply the correct tax information.

Web beacons. A web beacon, sometimes called a tracking pixel, is a small piece of code that can display an image on a web page and can also pass a unique identifier to a database. This allows us and our service providers to understand which pages you visit and which of our emails you open, so we can judge what products or services may be of interest to you. We use web beacons both on web pages and in email messages we send.

Other tools. We may also use web server logs (files in which website activity is stored) and SDKs (sets of tools or code embedded in software that allow third parties to collect information about how people use the Services). As we continue to develop our website and Services, we may introduce further methods of collecting information, and we will update this policy accordingly.

3. Information from social media and other platforms

We maintain a presence on a number of social media platforms. When you like or follow us on Facebook, Instagram, TikTok, LinkedIn, X or elsewhere, we may collect your name, your account handle, and any comments or content you post that relates to us. We also collect your information if you sign up for a promotion or submit information to us through one of our social media accounts.

Where we run blogs as part of our Services, we will collect your name and email address if you comment or post content there.

Cookies and similar technologies

Cookies are small text files that a website places on your device. We and our service providers use cookies to store small amounts of data about your visit to our website.

We use cookies to:

  • keep track of return visits to the website;

  • compile aggregate, statistical information about how the website is used;

  • deliver content based on your interests or past viewing history; and

  • remember your log-in so you can access the website more easily.

Under UK law we only place non-essential cookies — including analytics and advertising cookies — with your consent. When you first visit our website you will be asked to accept or reject these, and you can change your choice at any time through our cookie settings. Strictly necessary cookies, which are needed for the website to work, do not require consent.

You can also block or delete cookies through your browser settings, or set your browser to notify you when a cookie is set. Please note that if you block cookies, parts of the website may not work as intended.

How we use your information

Under UK GDPR we must have a lawful basis for each use of your personal data. The table below sets out what we do and why.

What we use your data for

Lawful basis

Setting up and administering your account, taking payment, delivering the Services you have ordered and dealing with your enquiries

Performance of a contract with you

Responding to customer support and technical assistance requests

Performance of a contract, or our legitimate interest in supporting our customers

Presenting our content in the most effective way for you and your device, and letting you use interactive features

Our legitimate interest in running the Services well

Keeping the Services safe and secure, and preventing fraud and misuse

Our legitimate interest in protecting our business and our users

Research and analysis to understand how effective our Services are and how to improve them

Our legitimate interest in improving what we offer

Measuring the effectiveness of our advertising and tailoring the content and advertising you see

Consent, where cookies or similar technologies are used

Sending you marketing about our own products and Services

Consent, or our legitimate interest where you are an existing customer and we are marketing similar services (the "soft opt-in")

Keeping records we are required to keep, and dealing with legal claims

Compliance with a legal obligation, or our legitimate interest in establishing or defending claims

Marketing communications. We may contact you by email, post, phone or text message about our products and Services, promotions and events. You can opt out at any time by using the unsubscribe link in any marketing email, by replying STOP to a text message, or by emailing [email protected]. We will not pass your details to unrelated third parties for their own marketing without your specific consent. If you opt out of marketing, you will still receive service messages about orders and bookings you have placed.

Combined information. We may combine information we collect through the Services with information we receive from other sources, online and offline, and use that combined information as described in this policy.

Aggregated and anonymised data. We may aggregate or anonymise information so that it can no longer be linked to you or your device. Once data is genuinely anonymised it is no longer personal data, and we may use and share it for any purpose, including research and marketing.

Analytics and advertising

Analytics. We use third-party web analytics services, such as Google Analytics, on our Services. These services use cookies and similar tools to collect and analyse usage information, help with auditing, research and reporting, assist with fraud prevention, and recognise the same user across browsers or devices so we can tailor our Services. These cookies are only set where you have consented. You can also prevent Google Analytics from collecting your data by installing the Google Analytics Opt-out Browser Add-on.

If you receive email from us, we may use tracking pixels to record when you open a message or click a link. This tells us how effective our communications are.

Online advertising. Our Services may include third-party advertising technologies, such as those provided by Meta (Facebook and Instagram) and Google Ads, that use cookies and similar technologies to deliver relevant advertising for our products both on our Services and on other websites and apps you use. These ads may be based on the page you are visiting, searches you have made, demographic data and other information we hold. Where required, we set these technologies only with your consent.

We may share customer information such as email addresses with advertising service providers, who match it in hashed form against their own user IDs so that we can show you more relevant ads. We do this only where we have a lawful basis to do so.

We do not control, and this policy does not cover, cookies or other tracking technologies placed on your device by unaffiliated third-party advertising networks. If you want to know more about tailored advertising and how to control it, you can visit the Your Online Choices website or the Digital Advertising Alliance's consumer opt-out page. We are not responsible for the continued availability or accuracy of these tools.

If you opt out, you will still see advertising when you use the Services, but it will not be tailored to you based on your online behaviour over time.

Mobile advertising. When using mobile apps you may also receive tailored in-app advertisements. Apple, Google and Microsoft each provide their own settings for limiting ad tracking and personalised in-app advertising; please refer to your device settings or the platform provider for details.

Do Not Track. Do Not Track ("DNT") is a privacy preference available in some browsers. There is no common industry standard for responding to DNT signals, and we do not currently respond to them. We instead give you the cookie controls and opt-out mechanisms described in this policy.

How we share your information

We may share your information in the following ways:

Affiliates and related businesses. We may share the information we collect with our affiliates or related companies so that we can deliver products and services to you, keep service consistent, and improve your experience as a customer.

Service providers and vendors. We share your information with selected third parties who perform services on our behalf. These include billing and payment processing, sales, marketing, advertising, analytics, research, customer service, delivery and fulfilment, data storage and hosting, IT and security, fraud prevention, and auditing and legal services. They may only use your data on our instructions and must keep it secure.

Legal compliance. We may access, keep and disclose information about you where reasonably necessary to comply with a court order, a request from a regulator or law enforcement, or an applicable legal obligation, or to enforce our Terms of Use or this policy, or to protect our legal rights.

Business transfers. If we buy, merge with or are acquired by another company, your information may be among the assets transferred. We will tell you if your data becomes subject to a different privacy policy.

Public forums. Some features of our Services let you post comments publicly. Anything you post in these areas is not confidential, and we may reuse it — for example, we may display a review you leave, along with the name you gave, on our own sites or on third-party sites. Information you post publicly may be indexed by search engines, so please take care.

Aggregated and anonymised information. We may create aggregated or anonymised data from the information we collect and share it at our discretion.

We do not sell your personal data.

Data security, retention and international transfers

Security. We use security measures consistent with prevailing industry standards to protect data against unauthorised access, whether physical or electronic. However, no transmission over the internet and no method of storage is completely secure. While we work hard to protect your personal data, we cannot guarantee the absolute security of information you send to us or that we store.

How long we keep your data. We keep your personal data only for as long as we need it for the purposes set out in this policy. In practice that means: account and transaction records for the duration of your relationship with us and for six years afterwards, to meet UK accounting and tax requirements; marketing data until you unsubscribe and for a short period afterwards so we can honour your opt-out; and analytics data for the retention period set in the relevant tool. Where we no longer need your data, we delete it or anonymise it.

International transfers. We are based in the United Kingdom, but some of our service providers are based outside the UK, including in the United States and the European Economic Area. Where we transfer personal data outside the UK, we make sure it is protected by an appropriate safeguard — either an adequacy decision covering the destination country, the UK International Data Transfer Agreement, or the UK Addendum to the EU Standard Contractual Clauses. You can ask us for details of the safeguard that applies to a particular transfer using the contact details below.

Your data protection rights

Because we are established in the United Kingdom, UK GDPR and the Data Protection Act 2018 apply to how we handle your personal data. If you are in the EU or EEA, EU GDPR may also apply. You have the following rights:

  • Access — to ask for a copy of the personal data we hold about you.

  • Rectification — to ask us to correct data that is inaccurate or incomplete.

  • Erasure — to ask us to delete your data where there is no good reason for us to keep it.

  • Restriction — to ask us to pause our use of your data while a concern is resolved.

  • Objection — to object to processing based on our legitimate interests, and to object to direct marketing at any time.

  • Portability — to receive the data you gave us in a structured, machine-readable format, or to have it sent to another controller.

  • Withdraw consent — where we rely on consent, to withdraw it at any time. This does not affect processing carried out before you withdrew it.

To exercise any of these rights, email us at [email protected]. We will respond within one month. There is normally no charge, and we may ask you to verify your identity before we act.

If you are unhappy with how we have handled your personal data, you can complain to the Information Commissioner's Office (ICO), the UK's supervisory authority, at ico.org.uk or on 0303 123 1113. We would appreciate the chance to address your concerns first.

Third-party links and content

Our website and the emails you receive from us may contain links to third-party websites. We are not responsible for the privacy practices or the content of those websites. Links are provided for your convenience only, and their inclusion does not imply that we endorse the site, its content or its operator.

Children's privacy

Our Services are not intended for children. We do not knowingly collect personal data from anyone under 18. If we become aware that someone under 18 has given us personal data through our Services, we will delete it and will not use it for any purpose. We encourage parents and guardians to talk to their children about the risks of sharing personal information online.

Changes to this policy

We may change or update this Privacy Policy from time to time. The date at the top of this page shows when it was last revised, and all information we collect is subject to the policy in place at the time of collection. Where a change is significant, we will bring it to your attention — for example by email or a notice on our website. Please check this page from time to time.

Refund Policy

7-day money-back guarantee

We want you to be happy with what you get from us. If you are not satisfied with the services you have received, you can ask for a full refund within 7 days — no questions asked.

You do not need to explain why. You do not need to prove anything went wrong. If you tell us within the window that you are not happy, we refund you.

How the 7 days are counted

The 7-day period runs from the date of your purchase, or from the date your service begins, whichever is later.

How to request a refund

Email [email protected] with the email address or name used for the purchase and the date of purchase. You can also reach us on +44 7541 443109 to start a request, but please follow up in writing so we have a record.

We will acknowledge your request within 2 working days.

How refunds are paid

Approved refunds are returned to the original payment method. We process refunds within 24 hours of approving the request. Depending on your bank or card issuer, the money may take a further 5 to 10 working days to appear on your statement.

Refunds are issued in the currency of the original payment. We do not charge a fee for processing a refund, but we are not responsible for any currency conversion differences or fees applied by your own bank.

After a refund

When a refund is issued, access to the relevant service ends. Where we have produced work for you, any licence or right of use granted in that work ends at the same time, and you agree to stop using it.

Your statutory rights

Nothing in this Refund Policy affects your legal rights. This guarantee is offered in addition to the rights you have under UK consumer law, including the right to cancel certain contracts made at a distance and the right to a remedy where a service is not carried out with reasonable care and skill.

Questions

If anything about this policy is unclear, contact us at [email protected] and we will explain it.
